1.3 These terms should be read together with our [Privacy Notice], which explains how we use your personal data, and our [Cookie Policy], which explains the cookies and similar technologies we use. If you use our recruitment services, separate terms of business will also apply.

2. Changes to these terms

2.1 We may update these terms from time to time, for example to reflect changes in the law or in how we operate. The version in force is the one on this page when you use the website, so please check it each time you visit.

2.2 Where a change is significant, we will take reasonable steps to make it clear on the website.

3. Availability of the website

3.1 The website is made available free of charge. We aim to keep it available at all times, but we do not guarantee that it, or any content on it, will always be available or uninterrupted.

3.2 We may suspend, withdraw or restrict access to all or part of the website for business or operational reasons, including system failure, maintenance or repair. We will try to give you reasonable notice of any planned suspension or withdrawal.

(a) you do not modify the content in any way;
(b) you do not use any photographs, graphics, video or audio separately from the accompanying text; and
(c) our status (and that of any identified contributors) as the authors of the content is always acknowledged.

5. Roles advertised and information you submit

5.1 Roles advertised on the website are provided for information only. They may be filled or withdrawn at any time, and their inclusion is not an offer of employment or engagement. Submitting an application or your CV does not guarantee that you will be put forward for a role or contacted.

5.2 If you submit your CV or any other information through the website, you confirm that it is accurate, that you are entitled to share it, and that it does not contain anything unlawful, misleading or offensive.

5.3 We will handle any personal data you submit in line with our [Privacy Notice]. We will not send your CV or identify you to a client without first telling you about the role and obtaining your agreement.

5.4 We use appropriate technical and organisational measures to protect information sent to us. However, no transmission over the internet is completely secure, so please contact us if you would prefer to send us your details by another method.

6.2 A breach of 6.1(b) to (d) may be a criminal offence under the Computer Misuse Act 1990. We may report any such breach to the relevant law enforcement authorities and cooperate with them, including by disclosing your identity. In that event, your right to use the website will end immediately.

7. Information on the website

7.1 The content on the website is provided for general information only. It is not intended to be advice on which you should rely. You should obtain professional or specialist advice before taking, or refraining from, any action on the basis of it.

7.2 Although we make reasonable efforts to keep the website up to date, we make no guarantee that its content is accurate, complete or current.

8. Links to and from other websites

8.1 Where the website contains links to other sites and resources provided by third parties, these are provided for your information only. We have no control over the content of those sites, are not responsible for them, and their inclusion should not be interpreted as our endorsement. Those sites have their own terms and privacy notices.

8.2 You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not suggest any form of association, approval or endorsement on our part where none exists. You must not frame the website on any other site.

9. Our responsibility for loss or damage

9.1 Whether you are a consumer or a business user: nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the law of England and Wales.

9.2 If you are a business user:

(a) we exclude all implied conditions, warranties, representations or other terms that may apply to the website or its content, to the extent permitted by law;
(b) we will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if foreseeable, arising under or in connection with your use of, or inability to use, the website, or your use of or reliance on any content on it; and
(c) in particular, we will not be liable for loss of profits, sales, business or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; or any indirect or consequential loss or damage.

9.3 If you are a consumer:

(a) the website is provided for your domestic and private use only. You agree not to use it for any commercial or business purpose, and we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity;
(b) we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is obvious it will happen, or if, at the time you used the website, both we and you knew it might happen; and
(c) these terms do not affect your statutory rights as a consumer.

9.4 We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack or other technologically harmful material that may infect your device, programs, data or other proprietary material due to your use of the website or your downloading of any content from it or from any website linked to it, where we have taken reasonable care to prevent this. You are responsible for configuring your own device to access the website and should use your own virus protection software.

9.5 We have no liability for the content of websites linked from the website, or for any loss or damage that may arise from your use of them.

10. Governing law and jurisdiction

10.1 If you are a consumer: these terms, their subject matter and their formation are governed by the law of England and Wales. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction. However, if you live in Scotland you can bring legal proceedings in either the Scottish or the English courts, and if you live in Northern Ireland you can bring legal proceedings in either the Northern Irish or the English courts.

10.2 If you are a business user: these terms, their subject matter and their formation, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.
